These Terms govern access to and use of the Fiduciary identity, login-security, consent, and audit API and related dashboards (the "Service"), operated by the Operator (the "Provider"). By creating an account or calling the API, you ("Customer") agree to these Terms.
The Service provides cryptographically signed identity verification, strong customer authentication, purpose-bound consent records, account safeguards, and a court-admissible audit ledger, exposed via HTTPS API endpoints and management dashboards. Signatures are produced with post-quantum cryptography (NIST FIPS 204).
You agree not to: (a) use the Service to violate any law or third-party right; (b) submit personal data you are not authorized to process; (c) probe, scan, or circumvent rate limits or security controls except as expressly permitted; (d) resell or sublicense the Service except under a written distribution agreement with the Provider.
Processing of personal data is governed by our Privacy Policy and, where the Customer is a controller, the Data Processing Agreement, which is incorporated by reference. The Provider processes Customer data under the Philippine Data Privacy Act (RA 10173) and acts as a processor on the Customer's instructions for personal data the Customer submits.
The Provider targets high availability but does not warrant uninterrupted service on the free tier. Any service-level commitment applies only where stated in a separate written agreement.
The Service, its software, and the published public keys remain the property of the Provider. You retain all rights in your own data. Verification of published signatures is expressly permitted.
The Service is provided "as is." The Provider disclaims implied warranties to the maximum extent permitted by law. The Service is a compliance and identity tool; it is not legal advice and does not by itself discharge any regulatory obligation that rests with the Customer.
To the maximum extent permitted by law, the Provider's aggregate liability arising out of the Service is limited to the fees paid by the Customer in the twelve (12) months preceding the claim. Neither party is liable for indirect or consequential damages. [VERIFY with legal]
The Provider may suspend access for breach of these Terms, non-payment, or suspected fraud or abuse. You may terminate at any time; fees already paid are non-refundable except as required by law.
The Provider may update these Terms; material changes will be notified by email or dashboard notice. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the Republic of the Philippines. Disputes are subject to the exclusive jurisdiction of the courts of [VENUE — TO BE SET], without prejudice to arbitration where agreed. Electronic acceptance is valid under RA 8792 (E-Commerce Act).
